A fully licensed general contractor needs an attorney to help him collect about $10,000.00 worth of unpaid work at a customer house. I finished a kitchen at a customer's house and I put a lot more work and material in their home than the contract was asking for and at the end they are now suing me in small claims court for the maximum allowable amount although I did everything right and they signed my final release. What I would like to do is to sue them for over $20,000.00 in the superior court and bring the small claim under one case to superior court. Let's sue them for defamation of character because they complaint to bbb and they have tarnished our reputation and also sue them for every little things that we did for them that was not in their invoice and they did not pay for it, such as full granite back splash and installing new window valance and installing a new garbage disposal under the sink and changing the big huge island twice. I also need help to file a mechanical lien on their house for $20,000.00. I would like to counter sue them in superior court due to the fact that first of all we did a lot of extra work in their house that I was not compensated for it and I can prove it in court and second of all they breached our invoice contract by not following the proper channel to settle their dispute with us and thirdly I think I have a better fighting chance once an attorney step in and fourthly they signed our releases after we had finished all of our works there and therefore there was no need for them to bring this lawsuit. There is also attorney fee clause on my invoice that can pay attorney for his/her time. I can pay the initial expenses like the court filing fee and then we can go 50/50 for any money you collect from them. I have these following clauses on my invoice that they signed. COMPLAINTS: Any complaints regarding quality of work or damages must be communicated in writing by fax or certified mail. Any complaint not communicated as indicated within 10 days of date damages were caused is considered waived.
